Welcome to PushNow. These Terms of Service (“Terms”) are a legal agreement between you and LDM Digital LLC (“the company”, “we”, “us”), the operator of the PushNow mobile application. By creating an account or using the app, you agree to these Terms.
1. Who can use the app
You must be at least 13 years old to use PushNow. If you are between 13 and 18, you may only use PushNow with the involvement and consent of a parent or guardian. By using PushNow you confirm you meet these requirements.
2. Your account
You can use most of PushNow as a guest, but some features (the leaderboard, push-up requests, cloud-synced history) require an account. We use email magic-link sign-in: when you enter your email, we send you a link that signs you in. There is no password. Keep your email account secure; anyone with access to your inbox can access your PushNow account.
You are responsible for any activity that happens on your account.
3. Acceptable use
When using PushNow, you agree NOT to:
- Use the app for any unlawful purpose
- Send unwanted, harassing, or spam push-up requests to people who do not want to receive them
- Use someone else’s email address without their permission to create requests
- Attempt to gain unauthorized access to other users’ accounts or our systems
- Reverse engineer, decompile, or extract the source code or models the app uses, except as permitted by applicable law
- Use bots or automated tools to inflate your rep counts, climb the leaderboard, or fake workout completions
- Resell the app, redistribute it, or offer it under your own brand
If you violate these rules, we may suspend or terminate your account without notice.
4. Push-up requests
PushNow lets users send “push-up requests” to friends. By sending a request, you confirm that:
- The recipient is a real person you know
- The recipient is reasonably expected to want to hear from you about push-ups
- You are not using the request feature to spam, harass, intimidate, or solicit anyone
We may block users who abuse this feature. Repeated abuse may result in permanent account termination.
5. Health and safety
PushNow is a fitness tracking and motivation tool, not a medical device. The app does not provide medical advice and is not a substitute for professional fitness coaching. Push-ups, like any exercise, carry a risk of injury.
By using PushNow, you confirm that:
- You are physically capable of safely performing push-ups
- You have consulted a healthcare professional if you have any condition that could be aggravated by exercise
- You are responsible for stopping exercise immediately if you feel pain, dizziness, or any other medical concern
- You assume all risk of injury related to using the app
We are not liable for any injury, illness, or other harm you experience while using PushNow.
6. Rep counts and AI analysis
PushNow uses on-device pose detection to count push-ups and assess form. This is best-effort: counts and form feedback may not be 100% accurate. Do not rely on PushNow for medical, training, or competitive certification purposes where exact accuracy is required.
7. Subscription, pricing, and refunds
PushNow is currently free to download and use. If we introduce paid features in the future, the pricing and refund terms will be presented to you at the point of purchase and processed through the Apple App Store. Refund requests for App Store purchases are handled by Apple, not by us.
8. Our intellectual property
The app, its design, the logo, the audio clips, the source code, the database structure, and all related content are owned by LDM Digital LLC. You receive a limited, non-exclusive, non-transferable license to use the app for personal use only. You do not acquire any ownership rights by using the app.
9. Your content
By creating workouts, profile information, and push-up requests, you grant us a worldwide, royalty-free license to store, display, and process that data solely to operate the app for you (e.g. showing you your history, ranking you on the leaderboard, delivering your requests). This license ends when you delete the relevant content or your account.
10. Termination
You can stop using PushNow and delete your account at any time (Settings → Account → Delete Account). When you do, all of your data is permanently deleted from our database.
We can suspend or terminate your account if you violate these Terms, abuse other users, or take any action that puts the app or our other users at risk.
11. Disclaimer of warranties
PushNow is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, accurate, or that defects will be corrected.
12. Limitation of liability
To the maximum extent permitted by law, LDM Digital LLC, its officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of PushNow. Our total liability for any claim related to the app is limited to the amount you have paid us in the last 12 months (which, if you use the free version, is zero).
Some jurisdictions do not allow the limitation of liability for personal injury or other harms; in those jurisdictions, the above limitation applies only to the maximum extent permitted by law.
13. Indemnity
You agree to defend, indemnify, and hold harmless LDM Digital LLC from any claim, damage, loss, liability, or expense (including legal fees) arising out of (a) your use of the app, (b) your violation of these Terms, (c) your violation of someone else’s rights, or (d) the content you submit to the app.
14. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the app will be resolved in the courts located in that jurisdiction, and you consent to the jurisdiction of those courts.
15. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the Last updated date at the top and, for significant changes, notify you by email or in the app. Your continued use of the app after the change means you accept the updated Terms.
